General Terms and Conditions
(1) Scope of application
(1) These General Terms and Conditions (GTC) apply to all current and future interactions between members and the Bavarian University Center for China at the University of Bayreuth in connection with the China Hub and the Bavarian China Alumni Portal of the University of Bayreuth.
(2) Membership
(2a) Members under these terms include individuals, legal entities, or partnerships with legal capacity who enter into a business relationship with the Bavarian University Center for China.
(2b) To access or contribute content, members must first complete the free registration process online (https://baychina-portal.de/de/). Members confirm that all information provided is accurate and complete and agree to update it promptly if it changes.
(2c) All information provided by the Bavarian University Center for China is non-binding and without guarantee of accuracy.
(3) Membership Fee
(3) Membership in the China Hub and the Bavarian China Alumni Portal of the University of Bayreuth is free of charge.
(4) Termination of Membership
(4) Membership may be terminated at any time by informal notice. The operators reserve the right to block members in accordance with the Community Guidelines.
(5) Responsibility for Content and Liability
(5a) Members are solely responsible for the content they provide, including its accuracy, legality, as well as for the content of the website(s) to which links are provided.
(5b) The Bavarian University Center for China reserves the right to remove published content if it violates applicable laws, third-party rights, public regulations, or accepted standards of conduct, or if it is otherwise deemed inappropriate. Members affected will be notified accordingly.
(6) Member Rights and Obligations
(6a) By posting the data, the member grants the provider a right of use free of charge.
(6b) If the member removes the content he/she has posted from the portal, the right of use and utilization granted to the provider shall expire. However, the Provider shall remain authorized to retain copies made for backup and/or verification purposes.
(6c) The member declares and guarantees to the provider that he/she is the sole owner of all rights to the content he/she has posted on the portal, or that others are authorised (e.g. by permission) to post the content on the portal and to grant the rights of use and exploitation in accordance with the above paragraph.
(6d) Members remain fully responsible for their contributions. The provider is not liable for accuracy, legality, completeness, quality or suitability for a particular purpose.
(7) Data protection
(7a) The member's data transmitted to the Bavarian University Centre for China at the University of Bayreuth will be collected, processed and used in compliance with the applicable data protection laws.
(7b) If the member receives a password upon registration, he/she are responsible for protecting the password from unauthorized access by third parties and must notify the Bavarian University Center for China immediately in writing if it is lost to have the password blocked.
(7c) By visiting the websites of the Bavarian University Centre for China of the University of Bayreuth, information about the access (date, time, page viewed) can be stored on the server. This data is not personal data, but is anonymized. They are analyzed exclusively for statistical purposes. It is not passed on to third parties for commercial or non-commercial purposes.
(7d) Furthermore, data may be stored on the website user's computer.
This data is called ‘cookies’, which serves to simplify the access behaviors of the user. This function can be disabled in browser settings, which may affect website functionality.
(7e) The Bavarian University Centre for China at the University of Bayreuth expressly points out that data transmission on the Internet (e.g. when communicating by e-mail) is subject to security vulnerabilities and cannot be completely protected against access by third parties.
(8) Liability
(8a) The University of Bayreuth shall be liable without limitation for the Bavarian University Centre for China in accordance with the statutory provisions, for damages resulting from intentional or grossly negligent injury to life, limb or health and under the German Product Liability Act.
(8b) Notwithstanding the above, liability for slight negligence shall only exist in the event of a breach of an ‘essential’ obligation arising from this agreement. ‘Essential’ obligations in this sense are obligations that are necessary for the fulfilment of agreements and whose breach would jeopardise the purpose of the agreement and on which reliance can therefore be placed. In these cases, liability is limited to typical and foreseeable damage; in other cases, there is no liability for slight negligence.
(9) Legal validity
(9a) If parts or individual formulations of this text do not, no longer or do not fully comply with the applicable legal situation, the content and validity of the remaining parts of the document shall remain unaffected.
(9b) Any subsidiary agreements or agreements deviating from these General Terms and Conditions must be made in writing.
(9c) The law of the Federal Republic of Germany shall apply exclusively to all legal relationships between the contracting parties, excluding its conflict-of-law rules.
(9d) The place of fulfilment and jurisdiction is Bayreuth.
(10) Others
(10) The legally binding form of these General Terms and Conditions is the German-language version.
